Comcast Introduces New Data Caps

Issues: 

Background: Since suspending its previous 250 GB data cap in May, Comcast has been working on developing new data caps.

Now, Comcast has introduced a new data caps initiative in Tucson, Arizona. Effective Oct. 1, the updated plan will impose caps ranging from 300 GB to 600 GB. Users who exceed their allotted amount of data will be subject to a $10 charge for an additional 50 GB of data.

Regardless of Comcast's changes, it remains unclear why tiered data caps are needed at all. The caps discourage internet use by forcing users to pay more to access information they need.

The following can be attributed to Michael Weinberg, Vice President of the Institute for Emerging Innovation:

Jump Over the Gap and Stay Under the Cap

A recent  survey of adults who use their cell phones to access the Internet found that 2 in 5 Latinos and half of African Americans- double the rate of Whites- conduct a majority or all of their web browsing via their cell phones. While smart phones enable communities to cross over the traditional digital divide and become Internet users, they are not perfect solutions. Data caps have the potential to restrict how and when Internet users go online. As data caps on mobile devices become standard practice, and unlimited data plans dissappear, the importance of carrier transparency about caps will increase.

Public Knowledge Demands FCC End Comcast's Discriminatory Use of Data Caps

Comcast has announced that its online video service on the Xbox 360 and TiVo will be exempted from its own data cap – a cap that applies to all other online video services.  Today, Public Knowledge filed a petition demanding that the FCC enforce its merger conditions that prohibited these types of arrangements.

The following can be attributed to Michael Weinberg, Vice President, Institute for Emerging Innovation at Public Knowledge:


“Comcast is doing exactly what opponents of its merger with NBC-Universal feared: using its internet business to protect its pay-TV business.  Exempting its own online video services from the data caps that apply to every other online activity creates an unfair advantage.

PK President and CEO Gigi Sohn was back on the Hill Wednesday morning, offering testimony before the House Subcommittee on Communications and Technology on “The Future of Video.”

The panel featured seven other members, including representatives from the broadcast, cable, satellite, movie, internet and streaming industries. Specifically, that means Charlie Ergen of DISH Network, Robert Johnson of Sky Angel, David Hyman of Netflix, Jim Funk of Roku, David Barrett of Hearst Television, Michael O'Leary of the MPAA, and Michael Powell of the NCTA (and formerly of the FCC) all joined Gigi on the panel. Needless to say, it was a big panel.
