Lofgren’s Task Force on the Global Internet

There has been a flurry of activity around Internet freedom recently. Not only have both parties included it in their platform, but Rep. Zoe Lofgren has taken an affirmative step in its favor by proposing the Global Free Internet Act of 2012, H.R. 6530 (a predecessor bill called the “One Global Internet Act” was proposed by Lofgren in 2010 with bipartisan support). The newly proposed bill does not directly change substantive law.

Bipartisan Letter Questions Domain Name Seizures

On Friday, Representatives Zoe Lofgren, Jason Chaffetz, and Jared Polis sent a letter to the Department of Justice and the Department of Homeland Security, demanding to know more about Operation In Our Sites, the program through which law enforcement authorities have been seizing the domain names of websites accused of hosting infringing content.

The letter, addressed to Attorney General Holder and Secretary of Homeland Security Napolitano, notes that seizing domain names without the proper respect for transparency and due process can suppress free speech and cripple legitimate businesses.

Public Knowledge Comments on Return of Rojadirecta Domain Names

Background: Today, the Department of Justice dismissed its case against Rojadirecta, returning to the company the domain names it seized over a year ago.

The following can be attributed to Sherwin Siy, Vice President of Legal Affairs:

"Like the unwarranted Dajaz1.com seizures, this case shows that the procedures for seizing domain names are flawed. It is far too easy for the government to seize domain names and hold them for an extended period even when it is unable to make a sustainable case of infringement.

"The constant expansion of copyright enforcement laws has given us a system where website owners are effectively treated as guilty until proven innocent. These sorts of abuses are likely to continue until there are adequate safeguards to assure accountability."

Intellectual Property in the TPP: How About a Little Balance?

This past Friday (August 17), Douglas E. Schoen published an op-ed in Politico lobbying for “strong” intellectual property (IP) protection in the Trans-Pacific Partnership Agreement (TPP). The op-ed argued that such an approach would be a "straightforward" route to "job-creating innovation." The op-ed ignored serious costs that over aggressive IP protection can pose to the economy, including the stifling of innovation in consumer electronics products and high monopolist prices for consumer goods including critical medicines. Like others before and since, the study Schoen cites does not support inferences linking particular IP demands in the TPP to innovation or jobs.

Public Knowledge Files Comments With the Office of the Intellectual Property Enforcement Coordinator

Today Public Knowledge filed comments with the Office of the Intellectual Property Enforcement Coordinator (IPEC) expressing concerns about the US government’s copyright enforcement strategy.

The following is attributed to Rashmi Rangnath, Director, Global Knowledge Initiative and Staff Attorney:

“To be successful, a copyright enforcement strategy must be targeted and avoid collateral damage to innocent actors. Instead, Operation in Our Sites, the domain name seizure strategy being pursued by Immigration and Customs Enforcement (ICE) casts too wide a net that captures some infringing content and a lot of lawful content. This strategy tramples over the free speech and due process rights of citizens.

“The government must reevaluate its enforcement strategy and ensure that it only narrowly targets infringing content, not entire websites.”

What's Going on with the Copyright Alert System?

As I wrote in April, I joined the Advisory Board of the Center for Copyright Information to serve as consumers’ eyes and ears as an agreement between the major Internet service providers and copyright holders is implemented.   The agreement requires ISPs to send up to six “alerts” to alleged peer-to-peer infringers, with the last two alerts resulting in so-called “mitigation measures” and an opportunity for the user to appeal.

Attached is testimony that PK President delivered to the House Judiciary Subcommittee on Courts, the Internet and Intellectual Property on September 26, 2002. The proposed 2002 legislation would have legalize sending viruses into computers to protect copyright.
