This bill, H.R. 3261, or "The Stop Online Piracy Act" (SOPA), is supposed to curb infringing websites by allowing the Department of Justice to block them, but—to add insult to injury—it doesn't even do that effectively. Secret Bill Pushes Part of SOPA and Wastes Your Money

A mere 5 months after SOPA and PIPA met their very public demise, a new intellectual property enforcement bill is on the fast track through the House Judiciary Committee.  The bill, which was largely secret until a day before it was scheduled to be marked up, is an attempt to revive an idea that was killed as part of SOPA earlier this year.  In addition to being a surprising attempt to develop intellectual property (IP) legislation in secret again, it highlights a phenomenal waste of taxpayer resources.  After all, what is going to improve our copyright system more: international IP attaches or being able to look up who actually owns a copyright?

Public Knowledge is excited to be part of the 91 organizations and 38 influencers signing on to the Declaration of Internet Freedom, which launched today.

As Cory Doctorow succinctly put it, “There is no copyright policy, only Internet policy; there is no Internet policy, only policy.” Today’s focus on increased IP enforcement will have a dramatic impact on the way people interact with the most democratic communications platform that has ever existed: the internet. Disproportionate IP enforcement will stifle creativity and create gatekeepers that block the free flow of information online.

Appeals Court Rejects Viacom Arguments Against YouTube

In their case against YouTube, Viacom and other content companies keep looking for ways to impose a duty to monitor on the video-sharing site. Despite the Digital Millennium Copyright Act's (DMCA) clear statements that services don't need to monitor, the content companies keep trying to pick away at other components of the law to work their way around it. (Public Knowledge filed a friend-of-the-court brief in this case, arguing that filters and monitoring aren't required to meet the DMCA requirements)

Today, the Second Circuit Court of Appeals in New York shot down the majority of those theories. Meanwhile, the case has been sent back to the district court level for more factfinding on exactly how much YouTube employees may have known about the presence of specific infringing files on their service.

People Powered Politics - SOPA & PIPA EBook

Our friends at Demand Progress & Engage DC have been working on a new e-book chronicling the fight against SOPA & PIPA, and the first chapters have just been released.  Available now is the lead-off chapter by PK’s own Director of Government Affairs Ernesto Falcon, "People Powered Politics"

Much like the opposition against these bills, content for this e-book is coming from a diverse and talented group of activists and entrepreneurs who each contributed something unique to the cause.

USTR Still Missing the Point

Yesterday, I attended the Senate Finance Committee Hearing on the President’s 2012 Trade Agenda. United States Trade Representative Ambassador Ron Kirk was the sole witness and testified on behalf of the Administration. The hearing was an opportunity for UTSR to soothe public concerns and address the recent scrutiny it’s received for the secretive negotiation process surrounding TPP negotiations. Instead the USTR failed to seriously address the lack of public input within negotiations.
