This bill, H.R. 3261, or "The Stop Online Piracy Act" (SOPA), is supposed to curb infringing websites by allowing the Department of Justice to block them, but—to add insult to injury—it doesn't even do that effectively. "It appears that lawmakers are beginning to realize how much damage their anti-'piracy' bills could cause to the Internet and to Internet-related businesses.  Today, House Judiciary Committee Chairman Lamar Smith (R-TX) said he would remove the highly controversial provision in the Stop Online Piracy Act (SOPA) that would require Internet Service Providers to block access to Web sites.

"In addition, today six Republican members of the Senate Judiciary Committee told Majority Leader Harry Reid (D-NV) that consideration of the Senate version of the legislation, Protect Intellectual Property Act (PIPA) should be postponed.

Public Knowledge Continues To See Issues With Senate Internet "Piracy" Bill

Background: Senate Judiciary Committee Chairman Patrick Leahy (D-VT) indicated today he will effectively remove from his Protect Intellectual Property Act (PIPA) bill the controversial mandate to block access to Web sites accused of hosting infringing material.

"We appreciate the action Chairman Leahy is taking to improve his legislation.  Even with that change, however, the bill would still be unacceptable.  The definitions in the bill are still far too sweeping, it still grants too much enforcement power to private parties,  and still confers inappropriate blanket immunity for private companies.

In the next couple of weeks, Congress will come back to Washington to start debating, once again, legislation that would severely limit innovation online, limit free speech and weaken cybersecurity, all in the name of protecting the big content companies.

I keep getting asked if the PROTECT IP Act (PIPA) is better or worse than the Stop Online Piracy Act (SOPA). Even without addressing how misleading relative terms like "better" can be, it's impossible to give an unequivocal answer because of several significant differences between the details of the bills, even if they both do many of the same things (and do them badly).

So while both bills try to curb online infringement by tampering with the domain name system (DNS); allow private actors to de-fund targeted sites, and grant blanket immunity to certain intermediaries for taking copyright law into their own hands, each has its own peculiarities that cause additional problems.
