Earlier today, House Commerce Committee Chairman Henry Waxman (D-CA) and Senate Commerce Committee Chairman Jay Rockefeller (D-WVA) sent a letter to FCC Chairman Julius Genachowski advising him on how the FCC could move forward to address the FCC’s authority over broadband.

A copy of the letter is here.

The following statement is attributed to Gigi B. Sohn, president and co-founder of Public Knowledge:

“Chairman Waxman and Chairman Rockefeller are absolutely correct in their advice that the Federal Communications Commission (FCC) should use “all viable options” including a “change in classification” with a “light regulatory touch” to protect consumers and advance the goals of the National Broadband Plan.

“We have suggested that the Commission open a proceeding to determine the FCC’s authority in the wake of the Comcast case that includes as an option to be discussed a reclassification of broadband service into a more legally justified category than it now is.  This letter makes clear that Congressional leadership considers reclassification as an accepted option to be part of any Commission consideration of broadband authority.”
